California H1B Visa Lawyer
There are many excellent employment opportunities in the United States, and it makes sense that residents of other countries may want to temporarily move to the U.S. to work in their studied field. Additionally, there is significant talent in all countries around the world, and it is only natural that companies housed in the United States would want to be able to recruit and benefit from that talent.
Fortunately, the H1B visa can meet these exact needs. The H1B visa allows companies to sponsor foreign nationals to come and work temporarily for a period of up to six years. However, as with all other visas, getting an H1B visa means submitting substantial amounts of paperwork, gathering and organizing all the proper documentation, and also proving that you meet all the necessary qualifications in order to be eligible for this visa.
All of that can be difficult to keep up with. Luckily, with the help of an experienced California H1B visa lawyer, you won’t have to do it alone. Hiring an experienced immigration attorney from Singh Ahluwalia Attorneys at Law ensures that you have someone on your side throughout the entire visa application process.

The requirements are as follows:
- There must be an H1B visa available. Only 85,000 H1B visas are currently issued each fiscal year, and 20,000 of those are reserved specifically for students who have received a master’s degree or higher from a college or university in the United States.
- The compensation for the job must match the actual wage for the occupation.
- The applicant must hold at least a bachelor’s degree in their field or the equivalent experience, and the job they seek must be considered a “specialty occupation” directly related to their degree area.
- The applicant must be an employer/employee relationship wherein the applicant’s employer obtains a labor condition application from the U.S. Department of Labor before filing an H1B petition with the United States Citizenship and Immigration Services (USCIS).

Process to Apply for the H1B Visa
Once you have determined that the H1B visa best fits your situation, there are several steps that you must follow in order to apply for your visa. These steps are:
- Your employer in the United States must file a labor condition application with the Department of Labor.
- After this, your employer must file an I-129 form with the United States Citizenship and Immigration Services (USCIS).
- If the I-129 form is approved, the foreign national applicant will receive further instructions on obtaining their visa. The next steps may include traveling to the nearest U.S. consulate to participate in an interview and completing simple biometric tasks, such as taking fingerprints.
It will probably take anywhere from three to six months to obtain your H1B visa after you start the application process.
H1B Visas and Family Members
If you have obtained an H1B visa, you can bring along your spouse and any unmarried children under the age of 21 to the United States for the duration of your stay. It is worth noting that your family members will not be able to work in the United States unless they obtain separate work visas.
