H1B Visa Eligibility

You will need an H1B visaIf you want to work in the United States in a specialized field directly related to your college degree.

As stated above, all visa types have specific eligibility requirements, and the H1B visa is no different. The H1B visa has five individual requirements that the applicant must meet to considered eligible.

The requirements are as follows:

  • There must be an H1B visa available. Only 85,000 H1B visas are currently issued each fiscal year, and 20,000 of those are reserved specifically for students who have received a master’s degree or higher from a college or university in the United States.
  • The compensation for the job must match the actual wage for the occupation.
  • The applicant must hold at least a bachelor’s degree in their field or the equivalent experience, and the job they seek must be considered a “specialty occupation” directly related to their degree area.
  • The applicant must be an employer/employee relationship wherein the applicant’s employer obtains a labor condition application from the U.S. Department of Labor before filing an H1B petition with the United States Citizenship and Immigration Services (USCIS).

It will probably take anywhere from three to six months to obtain your H1B visa after you start the application process.

If you have obtained an H1B visa, you can bring along your spouse and any unmarried children under the age of 21 to the United States for the duration of your stay. It is worth noting that your family members will not be able to work in the United States unless they obtain separate work visas.

Duration of H1B Visa

Once issued, your H1B visa is valid for three years. However, there is a possible extension of another three years, allowing you to work in the United States for a total of six years.
